Requirements for DMCA Notice

To file a valid DMCA notice, you must provide a written communication that includes all of the following (17 U.S.C. § 512(c)(3)):

Filing a DMCA Counter-Notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a DMCA counter-notification.

Requirements for Counter-Notification

To file a valid counter-notification, you must provide a written communication that includes all of the following (17 U.S.C. § 512(g)):

  1. Your signature: Your physical or electronic signature
  2. Identification of removed material: Identify the material that was removed or disabled and the location where it appeared before removal
  3. Good faith statement: Include the following statement:
    "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled."
  4. Consent to jurisdiction: Include the following statement:
    "I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located (or the Northern District of California if my address is outside the United States), and I will accept service of process from the person who filed the original DMCA notice or an agent of that person."

Upon receipt of a valid counter-notification:

Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, LinkController has adopted a policy of terminating, in appropriate circumstances, accounts of users who are deemed to be repeat infringers. LinkController may also, at its sole discretion, limit access to the service and/or terminate the accounts of any users who infringe intellectual property rights, regardless of whether repeat infringement has occurred.
